The Criminal Law Section believes the current statutory scheme is adequate. The law currently places the burden of affirmative consent on the perpetrator. The Board is also concerned with the potential detrimental effect it may have on the victims.

Alcohol is included when defining “intoxicants” for statutes dealing with snowmobiling, ATV’s, boating and transportation. It’s time to close a glaring loophole where alcohol is specifically exempted in sexual assault statute 940.225(5)(ai)
