The two most crucial changes that will be enacted in this legislation are that the requirement that a judge must make the expungement determination "at the time of sentencing" is removed, along with the age 25 restriction on expungement eligibility.

Comments
My son, Andrew, died last January. I believe he would be alive today if this bill had been law. He was saddled with a felony conviction for being a drug addict--for possession of a small amount of heroin. This robbed him of his future.

Comments
People with mental illness are over-represented in the criminal justice system. Expungement is vital to their opportunities for employment, housing, benefits, etc. Having a record can close the door to these opportunities.

Comments
The WDAA is concerned this bill will add additional court hearings that must be staffed by an ADA. The 71 DA offices statewide are understaffed by 166 prosecutors and cannot take on additional duties while underpaying prosecutors statewide.
